Acceptance

By installing or using the Pink Vista iOS app (“Pink Vista”, “the app”), you agree to these Terms of Use. If you do not agree, do not install or use the app.

Pink Vista is published by Danielius Studio LLC, a Wyoming limited liability company at 30 N Gould St, Suite #5280, Sheridan, WY 82801, USA (“we”, “us”).

What Pink Vista is

Pink Vista is a personal scene journal for iPhone. Once a day, you tap the Capture button and the app saves Apple's Look Around scene at your current location as a journal entry. Over time, you build a visual record of the places you spent your days in. Entries stay on your device.

Pink Vista is a personal scene journal. It is NOT a navigation app, NOT a friend-locator, NOT a real estate tool, and NOT a turn-by-turn directions service. Look Around imagery is provided by Apple Maps and is subject to Apple's MapKit and Apple Maps terms.

The app makes no network calls except to Apple's MapKit (for Look Around scene data, only when you tap Capture) and to Apple's StoreKit for in-app purchases. See the Privacy Policy for details.

License

We grant you a personal, non-exclusive, non-transferable license to use Pink Vista on iOS devices you own or control, subject to Apple's standard App Store Licensed Application End User License Agreement (the “EULA”) which is incorporated by reference: apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and the Apple EULA conflict, the Apple EULA controls.

Free window and subscriptions

When you first install Pink Vista, every feature is unlocked for three days with no payment and no account. This is a no-strings free window, not a trial signup.

After the three-day window, you may continue using the app for free with up to three captured scenes lifetime, OR accept a one-time gift screen offering two weeks free of the Monthly subscription ($4/month after the two weeks). You may also purchase Annual ($25/year) or Lifetime ($59 one-time) at any time from the Settings screen.

All payments are processed through Apple's StoreKit and are subject to Apple's standard subscription terms, including auto-renewal. You can manage or cancel subscriptions at any time in the iOS Settings → Apple ID → Subscriptions screen.

The Lifetime tier is a one-time non-consumable purchase. It remains active for as long as Apple keeps Pink Vista available on the App Store under your Apple ID.

Acceptable use

You agree to use Pink Vista for personal, non-commercial purposes only. You agree not to reverse engineer, decompile, modify, redistribute, or create derivative works of Pink Vista, except to the extent expressly permitted by applicable law.

You will not use Pink Vista to monitor, follow, or capture the location of other people. The app is for journaling your own places, not anyone else's.

Not navigation, not safety-critical

Pink Vista is a reflection tool. The Look Around scenes and placemark names it stores are a record of where you were, not guidance for where to go. Do not rely on Pink Vista for navigation, emergency response, or any safety-critical decision. For navigation, use Apple Maps or another dedicated tool.

Disclaimers

Pink Vista is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Apple Look Around coverage, imagery quality, and placemark accuracy are determined by Apple and may vary by location.

To the maximum extent permitted by law, Danielius Studio LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the app.

Apple as third-party beneficiary

You acknowledge that these Terms are between you and Danielius Studio LLC, not Apple, and that Apple is not responsible for Pink Vista or its contents. Apple is a third-party beneficiary of these Terms and may enforce them against you.

Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Sheridan County, Wyoming, except where Apple's EULA requires otherwise.

Changes

We may update these Terms from time to time. Material changes will be reflected in the “Last updated” date at the top. Continued use of Pink Vista after a change constitutes acceptance of the new Terms.
