Terms of Use

Acceptance

By installing or using the Pink Span Android app (“Pink Span”, “the app”), you agree to these Terms of Use. If you do not agree, do not install or use the app.

Pink Span is published by Danielius Studio LLC, a Wyoming limited liability company at 30 N Gould St, Suite #5280, Sheridan, WY 82801, USA (“we”, “us”).

What Pink Span is

Pink Span captures one second of video each day. You tap a single record button and the app auto-stops at 1.0 seconds. The clip is stored on your device. At any time, the clips of the year play as one film, which you can share as a single video, for example to save it to your gallery. The app uses Android's standard camera and media tools for capture, storage, playback and stitching.

The app makes no network calls except to Google Play billing for in-app purchases. Your clips never leave the device. See the Privacy Policy for details.

License

We grant you a personal, non-exclusive, non-transferable license to use Pink Span on Android devices you own or control, as permitted by the Google Play Terms of Service. Where these Terms and the Google Play Terms of Service conflict, the Google Play Terms of Service control.

Free window and subscriptions

When you first install Pink Span, every feature is unlocked for three days with no payment and no account. This is a no-strings free window, not a trial signup.

After the three-day window, you may continue using the app for free with up to three saved clips. For unlimited clips you may buy Pro at any time from the paywall or the Settings screen: Monthly ($4/month), Annual ($25/year) or Lifetime ($59 one-time). There is no Google Play free trial.

All payments are processed through Google Play billing and are subject to Google Play's standard subscription terms, including renewal until you cancel. You can manage or cancel subscriptions at any time in the Google Play app: tap your profile picture, then Payments and subscriptions, then Subscriptions.

The Lifetime tier is a one-time non-consumable purchase. It remains active for as long as Pink Span stays available to your Google account on Google Play.

Camera, microphone and your recordings

Pink Span requires Camera permission to capture clips and asks for Microphone permission so each clip keeps its sound; without the Microphone, clips save without sound. You grant or revoke these permissions in Android Settings > Apps > Pink Span > Permissions. The app uses the camera and the microphone only while its camera screen is open, and records only for the second after you tap record. It records 1-second clips at standard video resolution, stores them on your device, and never uploads them. You are responsible for what you choose to record, including obtaining consent from anyone visible or audible in your clips where required by applicable law.

The stitched year film can be shared as one video through the Android share sheet, for example to save it to your gallery, where the sharing controls of the app you pick apply.

Acceptable use

You agree not to reverse engineer, modify, redistribute, or create derivative works of Pink Span, except to the extent expressly permitted by applicable law. You agree not to use Pink Span to record any person without consent where consent is required, or to capture content that violates applicable law.

Disclaimers

Pink Span is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Danielius Studio LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the app, including loss of recorded clips due to device failure, deletion, or any other cause.

Who these Terms are with

You acknowledge that these Terms are between you and Danielius Studio LLC, not Google, and that Google is not responsible for Pink Span or its contents.

Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Sheridan County, Wyoming, except where Google's EULA requires otherwise.

Changes

We may update these Terms from time to time. Material changes will be reflected in the “Last updated” date at the top. Continued use of Pink Span after a change constitutes acceptance of the new Terms.
