Acceptance

By installing or using the Pink Tide iOS app (“Pink Tide”, “the app”), you agree to these Terms of Use. If you do not agree, do not install or use the app.

Pink Tide is published by Danielius Studio LLC, a Wyoming limited liability company at 30 N Gould St, Suite #5280, Sheridan, WY 82801, USA (“we”, “us”).

What Pink Tide is

Pink Tide is a personal daily-artifact app for iPhone. Once a day, you tap a capture button. The app takes a one-shot foreground-only CoreLocation fix, asks Apple WeatherKit for the current conditions at that point, and uses Apple's on-device Foundation Models to write a short eight-line poem from the weather. The tide becomes a dated entry (weather snapshot + poem) you can revisit, plus a printable year book of 365 poems and a Lock Screen widget when you unlock Pro.

Pink Tide is not a weather forecast app, a marine-tide chart, a navigation tool, or a substitute for official weather warnings. It is a creative-writing toy that reflects the weather where you are at the moment you tap.

Poem generation requires iOS 26 or later on an Apple Intelligence-capable iPhone (iPhone 15 Pro, iPhone 16, or newer with the A17 Pro chip or later). On unsupported devices, tides still save with the weather snapshot, but the poem step is unavailable.

The app makes no network calls except to Apple WeatherKit and to Apple's StoreKit for in-app purchases. The language model runs entirely on-device. See the Privacy Policy for details.

Location and WeatherKit and what we do with them

Pink Tide takes a one-shot foreground-only location fix only when you explicitly tap the capture button. The coordinates are used to query Apple WeatherKit and to save the place the poem came from alongside the tide entry on your device. Pink Tide does NOT track your location in the background and does NOT use significant-location-change monitoring. WeatherKit responses are subject to Apple's WeatherKit attribution and terms.

License

We grant you a personal, non-exclusive, non-transferable license to use Pink Tide on iOS devices you own or control, subject to Apple's standard App Store Licensed Application End User License Agreement (the “EULA”) which is incorporated by reference: apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and the Apple EULA conflict, the Apple EULA controls.

Free window and subscriptions

When you first install Pink Tide, every feature is unlocked for three days with no payment and no account. This is a no-strings free window, not a trial signup.

After the three-day window, you may continue using the app for free with up to three tide entries lifetime, OR accept a one-time gift screen offering two weeks free of the Monthly subscription ($4/month after the two weeks). You may also purchase Annual ($25/year) or Lifetime ($59 one-time) at any time from the Settings screen. Pro unlocks unlimited tides, the printable year book of 365 poems, and the Lock Screen widget.

All payments are processed through Apple's StoreKit and are subject to Apple's standard subscription terms, including auto-renewal. You can manage or cancel subscriptions at any time in the iOS Settings → Apple ID → Subscriptions screen.

The Lifetime tier is a one-time non-consumable purchase. It remains active for as long as Apple keeps Pink Tide available on the App Store under your Apple ID.

Acceptable use

You agree not to reverse engineer, modify, redistribute, or create derivative works of Pink Tide, except to the extent expressly permitted by applicable law. Do not rely on Pink Tide for navigation, marine safety, severe-weather decisions, or any other use where weather accuracy is safety-critical.

Not therapy, not medical advice, not a weather forecast

Pink Tide is a personal-artifact and creative-writing tool. The poems are generated by an on-device language model from a weather snapshot and are not therapy, diagnosis, or medical advice. The weather snapshot itself is provided by Apple WeatherKit and may differ from official weather services; do not use it as a forecast or as a basis for safety-critical decisions.

Disclaimers

Pink Tide is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Danielius Studio LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the app, including any reliance on the weather snapshot returned by Apple WeatherKit.

Apple as third-party beneficiary

You acknowledge that these Terms are between you and Danielius Studio LLC, not Apple, and that Apple is not responsible for Pink Tide or its contents. Apple is a third-party beneficiary of these Terms and may enforce them against you.

Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Sheridan County, Wyoming, except where Apple's EULA requires otherwise.

Changes

We may update these Terms from time to time. Material changes will be reflected in the “Last updated” date at the top. Continued use of Pink Tide after a change constitutes acceptance of the new Terms.
