Acceptance

By installing or using the Pink Roost iOS app (“Pink Roost”, “the app”), you agree to these Terms of Use. If you do not agree, do not install or use the app.

Pink Roost is published by Danielius Studio LLC, a Wyoming limited liability company at 30 N Gould St, Suite #5280, Sheridan, WY 82801, USA (“we”, “us”).

What Pink Roost is

Pink Roost is a wildlife sighting journal. You tap the capture button, the live camera opens, you snap a photo of the animal you spotted, type the species, and the app attaches your coordinates at save time. At year end, Pink Roost gives you a printable species list and a map of where each sighting happened. The app makes no network calls except to Apple's StoreKit for in-app purchases. License

We grant you a personal, non-exclusive, non-transferable license to use Pink Roost on iOS devices you own or control, subject to Apple's standard App Store Licensed Application End User License Agreement (the “EULA”) which is incorporated by reference: apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and the Apple EULA conflict, the Apple EULA controls.

Free window and subscriptions

When you first install Pink Roost, every feature is unlocked for three days with no payment and no account.

After the three-day window, you may continue using the app for free with up to three saved sightings lifetime, OR accept a one-time gift screen offering two weeks free of the Monthly subscription ($4/month after the two weeks). You may also purchase Annual ($25/year) or Lifetime ($59 one-time) at any time from the Settings screen.

All payments are processed through Apple's StoreKit and are subject to Apple's standard subscription terms, including auto-renewal. You can manage or cancel subscriptions at any time in the iOS Settings → Apple ID → Subscriptions screen.

The Lifetime tier is a one-time non-consumable purchase. It remains active for as long as Apple keeps Pink Roost available on the App Store under your Apple ID.

Respect wildlife and applicable law

You agree NOT to use Pink Roost to harass, bait, chase, or otherwise disturb wildlife, and NOT to enter protected, restricted, or private land without permission in order to capture a sighting. Ethical wildlife-watching standards and local, state, federal, and international laws (including protected-species statutes) apply to your conduct in the field — Pink Roost neither overrides nor relaxes any of them.

The coordinates Pink Roost attaches to a sighting are a personal-reference convenience and do NOT constitute scientific evidence, a survey record, or a legal observation report. GPS accuracy varies with terrain, sky visibility, and device state. Do not rely on Pink Roost data for research, regulatory reporting, or any decision where a verified observation is required.

Acceptable use

You agree not to reverse engineer, modify, redistribute, or create derivative works of Pink Roost, except to the extent expressly permitted by applicable law.

Disclaimers

Pink Roost is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Danielius Studio LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the app.

Apple as third-party beneficiary

You acknowledge that these Terms are between you and Danielius Studio LLC, not Apple, and that Apple is not responsible for Pink Roost or its contents. Apple is a third-party beneficiary of these Terms and may enforce them against you.

Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Sheridan County, Wyoming, except where Apple's EULA requires otherwise.

Changes

We may update these Terms from time to time. Material changes will be reflected in the “Last updated” date at the top. Continued use of Pink Roost after a change constitutes acceptance of the new Terms.
