Acceptance

By installing or using the Pink Mark iOS app (“Pink Mark”, “the app”), you agree to these Terms of Use. If you do not agree, do not install or use the app.

Pink Mark is published by Danielius Studio LLC, a Wyoming limited liability company at 30 N Gould St, Suite #5280, Sheridan, WY 82801, USA (“we”, “us”).

What Pink Mark is

Pink Mark turns physical book pages into a year quotebook. You point your iPhone camera at a page using Apple's VisionKit document scanner. The captured image is processed entirely on your device: Apple's Vision framework recognizes the text, and on Apple Intelligence-capable iPhones (iPhone 15 Pro, iPhone 16, or newer) Apple's Foundation Models extract the single most striking line. On older devices the recognized text is surfaced for you to trim manually.

Captured page images are kept in memory only — they are never written to disk, never sent off the device, and never used to train any model. Only the quote you choose to save is persisted. See the Privacy Policy for details.

License

We grant you a personal, non-exclusive, non-transferable license to use Pink Mark on iOS devices you own or control, subject to Apple's standard App Store Licensed Application End User License Agreement (the “EULA”) which is incorporated by reference: apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and the Apple EULA conflict, the Apple EULA controls.

Free window and subscriptions

When you first install Pink Mark, every feature is unlocked for three days with no payment and no account.

After the three-day window, you may continue using the app for free with up to three saved quotes lifetime, OR accept a one-time gift screen offering two weeks free of the Monthly subscription ($4/month after the two weeks). You may also purchase Annual ($25/year) or Lifetime ($59 one-time) at any time from the Settings screen.

All payments are processed through Apple's StoreKit and are subject to Apple's standard subscription terms, including auto-renewal. You can manage or cancel subscriptions at any time in the iOS Settings → Apple ID → Subscriptions screen.

The Lifetime tier is a one-time non-consumable purchase. It remains active for as long as Apple keeps Pink Mark available on the App Store under your Apple ID.

What you scan is your responsibility

You agree to use Pink Mark only to scan pages of works you own or are legally permitted to copy short passages from for personal, non-commercial reference. Pink Mark is intended for private notetaking under fair use, not for republishing or redistributing copyrighted content.

Acceptable use

You agree not to reverse engineer, modify, redistribute, or create derivative works of Pink Mark, except to the extent expressly permitted by applicable law.

Disclaimers

Pink Mark is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The Apple Intelligence extraction may misidentify the most striking line; review the suggested quote before saving.

To the maximum extent permitted by law, Danielius Studio LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the app.

Apple as third-party beneficiary

You acknowledge that these Terms are between you and Danielius Studio LLC, not Apple, and that Apple is not responsible for Pink Mark or its contents. Apple is a third-party beneficiary of these Terms and may enforce them against you.

Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Sheridan County, Wyoming, except where Apple's EULA requires otherwise.

Changes

We may update these Terms from time to time. Material changes will be reflected in the “Last updated” date at the top. Continued use of Pink Mark after a change constitutes acceptance of the new Terms.
