Terms of Use
Acceptance
By installing or using the Pink Keeper iOS app (“Pink Keeper”, “the app”), you agree to these Terms of Use. If you do not agree, do not install or use the app.
Pink Keeper is published by Danielius Studio LLC, a Wyoming limited liability company at 30 N Gould St, Suite #5280, Sheridan, WY 82801, USA (“we”, “us”).
What Pink Keeper is
Pink Keeper is a fully on-device photo culling app for iPhone. It groups the near-identical shots in your library, such as camera bursts and near-duplicates, pre-picks the frame you would most likely have kept, gives you a one-line reason for the pick, and learns from every disagreement. The model that does the picking is built into the app and is shaped by your own past choices: your Favorites, your edits, and the frames you kept from earlier bursts.
Every image is read and analysed on your iPhone. Nothing is uploaded, there is no account, and the app makes no network calls except to Apple's StoreKit for in-app purchases. See the Privacy Policy for details.
Suggestions, not decisions
Pink Keeper makes suggestions about which shot in a group is worth keeping. Those suggestions are the output of a statistical model and will sometimes be wrong. You are always the one who decides what is kept and what is not.
The app never deletes a photo on its own. Keepers are written into a new album in your own photo library and the rest of the group is left untouched. If you choose to delete, iOS shows its own confirmation and the images go to Recently Deleted like any other deletion.
You are responsible for your own backups. Keep your library backed up through iCloud Photos or another backup of your choosing before doing any bulk clean-up, in this or any other app. We are not liable for images you choose to remove.
License
We grant you a personal, non-exclusive, non-transferable license to use Pink Keeper on iOS devices you own or control, subject to Apple's standard App Store Licensed Application End User License Agreement (the “EULA”) which is incorporated by reference: apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and the Apple EULA conflict, the Apple EULA controls.
Your photos stay yours
Pink Keeper claims no rights of any kind over the images in your library. It is your content, it stays on your device, and the app is only a tool you point at it. You are responsible for having the right to the images you review in the app.
Free tier and subscriptions
Pink Keeper is free to use on your 300 most recent photos, with no ads and no credits, permanently. There is no signup and no payment required to use that tier.
Pro unlocks your whole library along with the taste profile and export. It is sold as Monthly ($4 per month, auto-renewing, with a 14-day free introductory period), Annual ($25 per year, auto-renewing), or Lifetime ($59 one-time, no subscription). Prices shown are United States prices; your local price is shown in the app before you buy. Apart from the Monthly introductory period, nothing is billed until you choose a plan and confirm the purchase.
All payments are processed through Apple's StoreKit and are subject to Apple's standard subscription terms, including auto-renewal. You can manage or cancel subscriptions at any time in the iOS Settings → Apple ID → Subscriptions screen.
The Lifetime tier is a one-time non-consumable purchase. It remains active for as long as Apple keeps Pink Keeper available on the App Store under your Apple ID.
Acceptable use
You agree not to reverse engineer, modify, redistribute, or create derivative works of Pink Keeper, except to the extent expressly permitted by applicable law.
Disclaimers
Pink Keeper is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any pick the app makes matches the choice you would have made.
To the maximum extent permitted by law, Danielius Studio LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the app, including any loss of images.
Apple as third-party beneficiary
You acknowledge that these Terms are between you and Danielius Studio LLC, not Apple, and that Apple is not responsible for Pink Keeper or its contents. Apple is a third-party beneficiary of these Terms and may enforce them against you.
Governing law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Sheridan County, Wyoming, except where Apple's EULA requires otherwise.
Changes
We may update these Terms from time to time. Material changes will be reflected in the “Last updated” date at the top. Continued use of Pink Keeper after a change constitutes acceptance of the new Terms.
