Terms of Use

Acceptance

By installing or using the Pink Count iOS app (“Pink Count”, “the app”), you agree to these Terms of Use. If you do not agree, do not install or use the app.

Pink Count is published by Danielius Studio LLC, a Wyoming limited liability company at 30 N Gould St, Suite #5280, Sheridan, WY 82801, USA (“we”, “us”).

What Pink Count is

Pink Count is a personal mental-math sprint game for iPhone. You pick an event (an operation such as addition, subtraction, multiplication, or division, on whole numbers, integers, or fractions), and solve timed problems in your head. A streak of correct answers levels you up; a wrong answer drops you a level. Fraction answers are accepted in any equivalent form. Pro unlocks every event and a Lock Screen and Home Screen widget showing your personal best.

The app makes no network calls except to Apple's StoreKit for in-app purchases. All gameplay runs entirely on-device. See the Privacy Policy for details.

License

We grant you a personal, non-exclusive, non-transferable license to use Pink Count on iOS devices you own or control, subject to Apple's standard App Store Licensed Application End User License Agreement (the “EULA”), which is incorporated by reference: apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and the Apple EULA conflict, the Apple EULA controls.

Subscriptions and purchases

Pink Count is free to play. An optional Pro upgrade unlocks every event and the widget. Pro is available as:

• Pro Monthly: $3 per month (auto-renewing subscription).
• Pro Annual: $13 per year (auto-renewing subscription).
• Pro Lifetime: $29 one-time (non-consumable purchase).

All payments are processed through Apple's StoreKit and are subject to Apple's standard subscription terms. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Payment is charged to your Apple ID at confirmation of purchase, and your account is charged for renewal within 24 hours before the period ends. You can manage or cancel subscriptions at any time in the iOS Settings → Apple ID → Subscriptions screen. Prices shown are for the United States storefront; your local price and currency are displayed at the time of purchase.

The Lifetime tier is a one-time non-consumable purchase. It remains active for as long as Apple keeps Pink Count available on the App Store under your Apple ID. All Pro purchases are Family-Shareable through Apple's standard Family Sharing.

Acceptable use

• Don't reverse engineer, decompile, or attempt to extract source code.
• Don't use the app for anything illegal or harmful.
• Don't resell, sublicense, or redistribute the app outside the App Store.

No warranty

Pink Count is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Danielius Studio LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the app.

Apple as third-party beneficiary

You acknowledge that these Terms are between you and Danielius Studio LLC, not Apple, and that Apple is not responsible for Pink Count or its contents. Apple is a third-party beneficiary of these Terms and may enforce them against you.

Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Sheridan County, Wyoming, except where Apple's EULA requires otherwise.

Changes

We may update these Terms from time to time. Material changes will be reflected in the “Last updated” date at the top. Continued use of Pink Count after a change constitutes acceptance of the new Terms.
