Acceptance

By installing or using the Pink Beat iOS app (“Pink Beat”, “the app”), you agree to these Terms of Use. If you do not agree, do not install or use the app.

Pink Beat is published by Danielius Studio LLC, a Wyoming limited liability company at 30 N Gould St, Suite #5280, Sheridan, WY 82801, USA (“we”, “us”).

What Pink Beat is

Pink Beat is a personal daily-artifact app for iPhone. Once a day, you record 15 to 30 seconds of ambient sound. On iPhone 16 Pro and iPhone 17 Pro and newer, the capture format is iOS 26 spatial audio so the file can later be played back with head-tracked AirPods Pro. On older devices, the recording falls back to standard stereo AAC. The soundscape becomes a dated entry you can revisit, plus a year archive bundle and a Lock Screen widget when you unlock Pro.

Pink Beat is not a voice recorder for interviews or meetings, a podcast tool, a music production environment, a sound-classification or scene-detection service, or a substitute for a dedicated audio editor. Soundscapes are short ambient captures kept locally for your own personal reflection.

Spatial-audio capture requires iPhone 16 Pro or iPhone 17 Pro or newer running iOS 26. On unsupported devices, soundscapes still record using standard stereo AAC, but spatial playback metadata is unavailable.

The app makes no network calls except to Apple's StoreKit for in-app purchases. The audio file stays on-device. See the Privacy Policy for details.

Microphone permission and what we do with it

Pink Beat opens the microphone only during the 15 to 30 seconds of an active recording session that you start by tapping the record button. The audio is saved as a local file inside the app's private container. The app does not run speech recognition, does not transcribe the audio, does not classify the sound, and does not keep the microphone open in the background.

License

We grant you a personal, non-exclusive, non-transferable license to use Pink Beat on iOS devices you own or control, subject to Apple's standard App Store Licensed Application End User License Agreement (the “EULA”) which is incorporated by reference: apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and the Apple EULA conflict, the Apple EULA controls.

Free window and subscriptions

When you first install Pink Beat, every feature is unlocked for three days with no payment and no account. This is a no-strings free window, not a trial signup.

After the three-day window, you may continue using the app for free with up to three soundscape entries lifetime, OR accept a one-time gift screen offering two weeks free of the Monthly subscription ($4/month after the two weeks). You may also purchase Annual ($25/year) or Lifetime ($59 one-time) at any time from the Settings screen. Pro unlocks unlimited soundscapes, spatial playback through AirPods Pro on capable devices, the year archive export, and the Lock Screen widget.

All payments are processed through Apple's StoreKit and are subject to Apple's standard subscription terms, including auto-renewal. You can manage or cancel subscriptions at any time in the iOS Settings → Apple ID → Subscriptions screen.

The Lifetime tier is a one-time non-consumable purchase. It remains active for as long as Apple keeps Pink Beat available on the App Store under your Apple ID.

Acceptable use

You agree not to reverse engineer, modify, redistribute, or create derivative works of Pink Beat, except to the extent expressly permitted by applicable law. You are responsible for the audio you record and for ensuring that your recordings comply with local laws regarding recording ambient sound; the app provides no sharing or publishing surface, and entries are kept locally for your own personal reflection.

Not therapy, not medical advice

Pink Beat is a personal-artifact tool for capturing short ambient soundscapes. The year archive is a creative reflection surface, not a sound-therapy product, sleep-coaching tool, or medical device.

Disclaimers

Pink Beat is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Danielius Studio LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the app.

Apple as third-party beneficiary

You acknowledge that these Terms are between you and Danielius Studio LLC, not Apple, and that Apple is not responsible for Pink Beat or its contents. Apple is a third-party beneficiary of these Terms and may enforce them against you.

Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Sheridan County, Wyoming, except where Apple's EULA requires otherwise.

Changes

We may update these Terms from time to time. Material changes will be reflected in the “Last updated” date at the top. Continued use of Pink Beat after a change constitutes acceptance of the new Terms.
