Acceptance

By installing or using the Pink Rest Android app (“Pink Rest”, “the app”), you agree to these Terms of Use. If you do not agree, do not install or use the app.

Pink Rest is published by Danielius Studio LLC, a Wyoming limited liability company at 30 N Gould St, Suite #5280, Sheridan, WY 82801, USA (“we”, “us”).

What Pink Rest is

Pink Rest is a fully on-device noise-generation app for Android phones and tablets. It plays white, pink, brown, and green noise, includes a sleep timer, and turns into a bedside clock when your phone stands on its side on the charger.

Audio is synthesized locally on your device in real time. The app makes no network calls except to Google Play billing for in-app purchases. See the Privacy Policy for details.

License

We grant you a personal, non-exclusive, non-transferable license to use Pink Rest on Android devices you own or control, as permitted by the Google Play Terms of Service. Where these Terms and the Google Play Terms of Service conflict, the Google Play Terms of Service control.

Free window and subscriptions

When you first install Pink Rest, every feature is unlocked for three days with no payment and no account. This is a no-strings free window, and nothing is billed when it ends.

After the three-day window, you may continue using the app for free with white and pink noise only. Pro unlocks brown and green noise: you may purchase Monthly ($4/month), Annual ($25/year) or Lifetime ($59 one-time) at any time from the Settings screen.

All payments are processed through Google Play billing and are subject to Google Play's standard subscription terms, including renewal until you cancel. You can manage or cancel subscriptions at any time in the Google Play app: tap your profile picture, then Payments and subscriptions, then Subscriptions.

The Lifetime tier is a one-time non-consumable purchase. It remains active for as long as Pink Rest stays available to your Google account on Google Play.

Acceptable use

You agree not to reverse engineer, modify, redistribute, or create derivative works of Pink Rest, except to the extent expressly permitted by applicable law.

No medical claims

Pink Rest is a noise app intended for general focus, sleep, and relaxation use. We do not claim it diagnoses, treats, cures, or prevents any medical condition, including but not limited to insomnia, anxiety, or tinnitus. If you have a medical concern, consult a qualified healthcare professional.

Disclaimers

Pink Rest is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Danielius Studio LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the app.

Who these Terms are with

You acknowledge that these Terms are between you and Danielius Studio LLC, not Google, and that Google is not responsible for Pink Rest or its contents.

Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Sheridan County, Wyoming, except where Google's EULA requires otherwise.

Changes

We may update these Terms from time to time. Material changes will be reflected in the “Last updated” date at the top. Continued use of Pink Rest after a change constitutes acceptance of the new Terms.
