Terms of Use
Acceptance
By installing or using the Pink Wave iOS app (“Pink Wave”, “the app”), you agree to these Terms of Use. If you do not agree, do not install or use the app.
Pink Wave is published by Danielius Studio LLC, a Wyoming limited liability company at 30 N Gould St, Suite #5280, Sheridan, WY 82801, USA (“we”, “us”).
What Pink Wave is
Pink Wave is a personal hand-gesture archive for iPhone. You pick a photo from your Photos library or capture one with the camera, and Apple's on-device Vision framework detects the 21 joint landmarks of a single hand. Pink Wave renders those joints as a clean silhouette and saves it with a label you choose (peace, wave, fist, open hand, thumbs-up, and so on). The silhouette becomes a dated entry in a small personal collection of hand poses.
Pink Wave is not a sign-language interpreter, a medical or rehabilitation tool, a person-identification system, or a generic photo editor. It does not interpret the meaning of gestures beyond the label you assign. The original photo is discarded after detection; only the joint coordinates and the rendered silhouette are kept.
The app makes no network calls except to Apple's StoreKit for in-app purchases. The hand-pose detection runs entirely on-device. See the Privacy Policy for details.
Photos and Camera permissions
Pink Wave reads only the photo you explicitly pick through Apple's system picker, or the still you capture by tapping the in-app shutter. The app does not scan your broader Photos library, does not record video, and does not run any face-detection or person-identification pipeline. The single image is handed to Vision for hand-pose detection and then released; it is not written to disk by Pink Wave.
License
We grant you a personal, non-exclusive, non-transferable license to use Pink Wave on iOS devices you own or control, subject to Apple's standard App Store Licensed Application End User License Agreement (the “EULA”) which is incorporated by reference: apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and the Apple EULA conflict, the Apple EULA controls.
Free window and subscriptions
Pink Wave is free for the first three wave entries lifetime — no payment, no account, no time limit on those three captures.
To capture more, you may subscribe Monthly ($4/month with a 14-day intro offer) or Annual ($25/year), or purchase the Lifetime tier ($59 one-time) at any time from the Settings screen. Pro unlocks unlimited wave entries.
All payments are processed through Apple's StoreKit and are subject to Apple's standard subscription terms, including auto-renewal. The Monthly subscription renews at $4/month after the 14-day intro period. You can manage or cancel subscriptions at any time in the iOS Settings → Apple ID → Subscriptions screen.
The Lifetime tier is a one-time non-consumable purchase. It remains active for as long as Apple keeps Pink Wave available on the App Store under your Apple ID.
Acceptable use
You agree not to reverse engineer, modify, redistribute, or create derivative works of Pink Wave, except to the extent expressly permitted by applicable law. You are responsible for the photos you pick or capture and for ensuring you have the right to use them; the app provides no sharing or publishing surface, and wave entries are kept locally for your own personal collection.
Not therapy, not medical advice
Pink Wave is a personal-artifact tool. The silhouette and label are a record of a gesture you captured, not a clinical assessment, not a sign-language translation, and not a rehabilitation plan. The app does not interpret the meaning of your gestures beyond the label you assign and does not claim to address any medical condition.
Disclaimers
Pink Wave is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Danielius Studio LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the app.
Apple as third-party beneficiary
You acknowledge that these Terms are between you and Danielius Studio LLC, not Apple, and that Apple is not responsible for Pink Wave or its contents. Apple is a third-party beneficiary of these Terms and may enforce them against you.
Governing law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Sheridan County, Wyoming, except where Apple's EULA requires otherwise.
Changes
We may update these Terms from time to time. Material changes will be reflected in the “Last updated” date at the top. Continued use of Pink Wave after a change constitutes acceptance of the new Terms.
