Terms of Service
Acceptance
By installing or using the Pink Verse iOS app (“Pink Verse”, “the app”), you agree to these Terms of Service. If you do not agree, do not install or use the app.
Pink Verse is published by Danielius Studio LLC, a Wyoming limited liability company at 30 N Gould St, Suite #5280, Sheridan, WY 82801, USA (“we”, “us”).
What Pink Verse is
Pink Verse is an on-device daily sound poem for iPhone. When you hear something interesting and tap the capture button, the app records approximately six seconds of audio, classifies what it hears on-device using Apple's built-in SoundAnalysis classifier, and uses Apple's on-device Foundation Models to write a four-line poem from the top sound tags. The audio clip, the tags, and the poem all stay on your phone.
Pink Verse is not a music transcription service, a song-recognition service, a continuous voice recorder, or a surveillance tool. Audio clips are short (approximately six seconds) and are captured only when you tap the capture button. The microphone is not used at any other time.
Poem generation requires iOS 26 or later on an Apple Intelligence-capable iPhone (iPhone 15 Pro, iPhone 16, or newer). On older devices, the app shows a clear in-app notice that the poem step is unavailable.
The app makes no network calls except to Apple's StoreKit for in-app purchases. Sound classification and poem generation run entirely on-device. See the Privacy Policy for details.
License
We grant you a personal, non-exclusive, non-transferable, non-commercial license to use Pink Verse on iOS devices you own or control, for your personal enjoyment, subject to Apple's standard App Store Licensed Application End User License Agreement (the “EULA”) which is incorporated by reference: apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and the Apple EULA conflict, the Apple EULA controls.
Free window and subscriptions
When you first install Pink Verse, every feature is unlocked for three days with no payment and no account. This is a no-strings free window, not a trial signup.
After the three-day window, you may continue using the app for free with up to three sound poems lifetime, OR accept a one-time gift screen offering two weeks free of the Monthly subscription ($4/month after the two weeks). You may also purchase Annual ($25/year) or Lifetime ($59 one-time) at any time from the Settings screen. Pro unlocks unlimited poems, the year poem-book PDF export, and the Lock Screen widget.
All payments are processed through Apple's StoreKit and are subject to Apple's standard subscription terms, including auto-renewal. You can manage or cancel subscriptions at any time in iOS Settings → Apple ID → Subscriptions screen.
The Lifetime tier is a one-time non-consumable purchase. It remains active for as long as Apple keeps Pink Verse available on the App Store under your Apple ID.
Acceptable use
Pink Verse is licensed for personal, non-commercial use only. You agree not to reverse engineer, modify, redistribute, or create derivative works of Pink Verse, except to the extent expressly permitted by applicable law.
You also agree not to use Pink Verse in any way that interferes with another person's use of their device or violates the rights of any third party.
Recording consent and local law
When you tap the capture button, the app records approximately six seconds of audio from the iPhone microphone. You are solely responsible for complying with all laws that apply to audio recording in your jurisdiction, including one-party and two-party consent laws, workplace recording rules, and any restrictions on recording in private spaces, schools, hospitals, courtrooms, religious sites, or other regulated locations.
If a person near you has asked not to be recorded, do not capture. Audio captured by Pink Verse stays on your device, but the act of recording itself may be regulated regardless of where the resulting clip is stored.
Not therapy, not medical advice
Pink Verse is a creative writing tool for personal reflection on the sounds around you. The poems are generated by an on-device language model and are not therapy, diagnosis, or medical advice. The app does not interpret meaning, predict outcomes, or claim to address any mental, physical, or hearing-related condition. If you have concerns, consult a qualified professional.
Disclaimers
Pink Verse is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Sound classifications and generated poems are produced by machine learning models and may be inaccurate or inappropriate; we make no warranty as to their accuracy, suitability, or quality.
To the maximum extent permitted by law, Danielius Studio LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the app, including any damages arising from your decision to record audio in any particular setting.
Apple as third-party beneficiary
You acknowledge that these Terms are between you and Danielius Studio LLC, not Apple, and that Apple is not responsible for Pink Verse or its contents. Apple is a third-party beneficiary of these Terms and may enforce them against you.
Governing law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Sheridan County, Wyoming, except where Apple's EULA requires otherwise.
Changes
We may update these Terms from time to time. Material changes will be reflected in the “Last updated” date at the top. Continued use of Pink Verse after a change constitutes acceptance of the new Terms.
