Terms of Use

Acceptance

By installing or using the Pink Cinder iOS app (“Pink Cinder”, “the app”), you agree to these Terms of Use. If you do not agree, do not install or use the app.

Pink Cinder is published by Danielius Studio LLC, a Wyoming limited liability company at 30 N Gould St, Suite #5280, Sheridan, WY 82801, USA (“we”, “us”).

What Pink Cinder is

Pink Cinder is a personal depth-capture app for iPhone. You point the rear camera at a subject and tap to capture; the app records a HEIC photo together with the depth map produced by the camera system, then renders a false-color visualization showing how far each part of the scene sat from the lens. The capture becomes a dated entry with the minimum and maximum depth in meters, plus an optional note.

Pink Cinder is not a measurement tool, a surveying instrument, a 3D scanner, or a substitute for the Camera app. The depth values come from Apple's built-in depth estimation and are subject to its accuracy and lighting constraints. Cinders are personal artifacts kept locally on your device.

Depth capture requires an iPhone with a dual-camera system or LiDAR scanner (iPhone 7 Plus, 8 Plus, X, and later Pro/Pro Max models). On devices without a supported depth-capable camera, the capture screen will display a notice and the depth map step is unavailable.

The app makes no network calls except to Apple's StoreKit for in-app purchases. All depth rendering runs entirely on-device. See the Privacy Policy for details.

Camera permission and what we do with it

Pink Cinder uses the camera only while you are inside the capture screen, and only to record the photo and depth data for the cinder you are creating. The app does not run face detection, body pose, scene classification, or any other computer-vision pipeline on the camera feed. The captured frame and depth map are kept in the app's private container; Pink Cinder does not save the capture to your Photos library.

License

We grant you a personal, non-exclusive, non-transferable license to use Pink Cinder on iOS devices you own or control, subject to Apple's standard App Store Licensed Application End User License Agreement (the “EULA”) which is incorporated by reference: apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and the Apple EULA conflict, the Apple EULA controls.

Free window and subscriptions

When you first install Pink Cinder, every feature is unlocked for three days with no payment and no account. This is a no-strings free window, not a trial signup.

After the three-day window, you may continue using the app for free with up to three cinder entries lifetime, OR accept a one-time gift screen offering two weeks free of the Monthly subscription ($4/month after the two weeks). You may also purchase Annual ($25/year) or Lifetime ($59 one-time) at any time from the Settings screen. Pro unlocks unlimited cinders, the year wall PDF export, and the Lock Screen widget.

All payments are processed through Apple's StoreKit and are subject to Apple's standard subscription terms, including auto-renewal. You can manage or cancel subscriptions at any time in the iOS Settings → Apple ID → Subscriptions screen.

The Lifetime tier is a one-time non-consumable purchase. It remains active for as long as Apple keeps Pink Cinder available on the App Store under your Apple ID.

Acceptable use

You agree not to reverse engineer, modify, redistribute, or create derivative works of Pink Cinder, except to the extent expressly permitted by applicable law. You are responsible for the subjects you capture and for respecting the privacy of people and places in front of the camera; the app provides no editing, sharing, or publishing surface, and cinders are kept locally for your own personal reflection.

Not a measurement tool, not professional advice

Pink Cinder is a personal-artifact app that surfaces the camera's depth estimate as a visualization and a pair of headline numbers. The depth values are not a survey-grade measurement, not engineering data, and not advice of any kind. Do not rely on them for construction, navigation, accessibility compliance, medical decisions, or any other safety-critical purpose.

Disclaimers

Pink Cinder is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Danielius Studio LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the app.

Apple as third-party beneficiary

You acknowledge that these Terms are between you and Danielius Studio LLC, not Apple, and that Apple is not responsible for Pink Cinder or its contents. Apple is a third-party beneficiary of these Terms and may enforce them against you.

Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Sheridan County, Wyoming, except where Apple's EULA requires otherwise.

Changes

We may update these Terms from time to time. Material changes will be reflected in the “Last updated” date at the top. Continued use of Pink Cinder after a change constitutes acceptance of the new Terms.
